5   该委培生在学习期间，因自身原因终止学习或不能获得学位，甲方应将委托培养的研究生予以妥善安置，并不得向乙方索要培养费用。

二、乙方应承担的责任

1、委托培养研究生是国家招生规模内的研究生，对毕业时符合条件的，发给与计划内研究生相同的毕业证、学位证。

2、乙方要保证质量，严格按照《高等学校学生守则》和《培养方案》，努力把委托培养生培养成德、智、体全面发展的合格人才。

3、该生毕业后，乙方应将其毕业证书、学位证书及有关学籍档案直接寄往甲方。

4、该生因自身原因，不能继续培养的，乙方应如实向甲方说明情况，并将有关材料寄送甲方。

三、本合同有效期一般为三年。合同自签字之日起生效，至该生毕业离校之日止。

四、本合同如有未尽事宜，须经双方协商一致后，予以补充。

五、本合同一经签订，甲乙双方必须共同履行。如有一方违约，则应由违约方承担由此所造成的损失，并给另一方以经济赔偿。

1选题背景

中国房地产开发企业的融资渠道比较单一，主要依赖商业银行贷款，一旦国家收缩信贷，房地产企业将面临资金链断裂的危险。根据中国人民银行XX年第二季度货币政策执行报告，XX年上半年，商业性房地产贷款余额为6.21万亿元，同比增长18.8%，占同期全部人民币贷款余额的16.5%;其中，房地产开发贷款余额为2.35万亿元，同比增长20.5%，个人购房贷款余额为3.86万亿元，同比增长17.8%，房地产贷款余额占人民币贷款余额的比重达到16.5%。XX年，在房地产开发企业陷入销售停滞、信用紧缩以及证券市场首次公开发行(ipo)暂停的背景下，房地产开发企业的直接融资通道又被卡死。房地产业对银行资金的高度依赖性导致房地产市场的风险被大量转嫁给银行，从而使房地产金融积累了较大的金融风险。因此，房地产业迫切需要寻求银行外的融资渠道，以解决房地产开发与经营的资金短缺问题。在这种情况下，房地产投资信托基金进入了我们的视线。
