一、实习过程

这次实习我主要负责的是办公室文秘的工作。第一次走进办公室，一切都是那么陌生，所有的工作人员都各自忙着，仿佛没有人注意到我，这让我本来激动的心情多了一些慌乱。这个时候我想起了在学校时老师对我我们说的一句话，人的适应能力是无穷的。于是我深深的吸了一口气准备迎接接下来的一个个挑战。

说是文秘，其实我主要负责的就是打打文件，接接电话。多亏以前的练习，我的打字技术和质量足以应付领导交给我的任务。虽然只是坐了一天，但我还是感觉挺累的，再加上宿舍的简陋条件，生活真是给我上了意义非凡的一课，以前家长跟我们说一千遍挣钱多不容易，不如我亲身经历一天的感悟。

刚开始的几天就这么不咸不淡的过去了。在学校学到的东西并没用到多少，同事们也因为彼此工作没有交集依然十分陌生。只是见面打招呼的交情。看着他们整天忙碌着，闲暇之余彼此开开玩笑，觉得他们真的是一个集体，而我却像个局外人般悠闲。我想我不能再这样下去，于是，在办公室，有闲的时候就会看一些计算机方面的书，虽然自己所学的专业在此时没有派上什么用场，但我觉得应该多学点，以丰富自己的能力。

但这样下去也不是办法，复印、传真、等文秘工作我都还没有掌握。终于有一天我鼓起勇气向一名看起来很面善的年轻女同事请教了这方面的内容。没想到她不仅告诉了我发传真的方法还跟我说理很多文秘需要注意的事项。她告诉我文秘必须态度认真，细心，不能疏忽大意，不能马虎潦草。比如说办理公文，就要保证文件的质量，用词要准确，材料要真实，抄写要认真，校对要仔细，力求每一个环节都不发生差错。否则就会耽误工作，甚至酿成难以弥补的损失。最后为了让我掌握发传真的方法她又交给我一份需要发的传真让我练习。回到自己的座位上我一边体会着同事跟我说的话，一边发传真，当听到传真发送成功后的“嘟嘟”声，我便又小小地得意一番，虽然很傻，但至少又学会了一项办公器材的用法。

在这里我要特别感谢这位前辈，她不仅教给了我很多有用的东西，还把我介绍给其它的同事认识，以帮助我提高工作方面的能力。慢慢的我也不在只是闷着头做，遇到疑难的问题就请教这些前辈们，我觉得自己开始融入这个集体了。

在做打字发传真等枯燥工作的时候，我不止一次的幻想着公司忽然有英文的文件需要翻译，在大家焦头烂额，手足无措的时候，我镇定的走出来然后利用在学校学到的知识解决这个棘手的问题。但当幻想成为现实的时候，我却慌了阵脚。因为文件涉及的化学产品，金属元素等专有名词我连读都有困难更不用说翻译了。我只有达开电脑利用金山词霸一个个的查。即使这样还经常是单词的意思查到了却连不成句。仅仅四页纸我翻译了一天半。

依据《民法典》及有关法律法规，为明确出租方与承租方的权利和义务，遵循平等、自愿、公平和诚信的原则，双方就工程钻机、挖土机及钢板租赁事宜协商一致，订立本合同。

第一条设备名称、型号、规格及数量：______________

第二条租赁期限

设备租赁期限为个月，即自年月________日至年月________日。

承租方因工程需要延长租期，应在合同届满前7________日内，重新签订合同。

第三条租金及支付

1.租金及计算：工程钻机租金________元/月挖土机租金________元/月12钢板每片________元/月，实际使用不足月部分按照月租费÷30天×实际使用天数计算。

2.租金支付：租赁费用按月计算。每月的25________日由出租方开具当月租赁费结算单及收据交承租方办理月结算手续。承租方应按建设单位支付工程款的情况按月支付租赁费。

3.租赁计费起止时间

._______年_______月________日为本次设备租赁的计费开始时间，如果设备到达工地后承租方仍不开工，租赁时间照常计算。

.在机械租赁期间，因承租方原因或自然原因造成的机械停工，也按日历天数照常计算，承租方未按合同规定期限预付租费而停机，也按日历天数照常计算机械租赁计费时间。

.机械退租时，承租方必须向出租方发出书面通知，出租方接到书面通知并认可的退租________日期为本次的计费结束时间。

4.运转时间及租赁费签认：机械到达工地之日属出租方原因若不能施工不作计费，承租方必须办理到达________日期的签收手续。租赁计费时间开始后，双方每月签认一次机械租赁费。最后一次为退租之________日。

5.机械的进退场费：机械的进出场运输由出租方负责办理，承租方协助装卸车。机械的进出场费全部由承租方承担。

第五条租赁方式及所有权

1.租赁方式：本设备的租赁由出租方配备操作人员。负责设备的操作和维护保养工作。

2.租赁设备的所有权：合同附件所列租赁设备的所有权属于出租方，承租方对租赁机械只享有租赁期间的使用权，没有设备的所有权。

3.未经出租方同意，承租方不得在设备上随意增加或减少部件，也不得以任何理由对设备进行抵押，否则由此造成的全部后果由承租方承担。

第六条押金

经双方协商，出租方收取承租方押金________元。承租方交纳后办理提货手续。租赁期间不得以押金抵作租金租赁期满，扣除应付租赁物资缺损赔偿金后，押金余额退还承租方。

第七条设备的验收、安装、调试、使用、保养、维修管理等均由承租方自行负责。

第八条租赁机械的毁损和灭失

1.承租方承担在租赁期内发生的承租方责任租赁机械的毁损和灭失的风险。由不可抗力的原因不能履行合同或造成损失时双方根实际情况协商解决。

2.在租赁机械发生毁损和灭失时，承租方应立即通知出租方，出租方有权选择下列方式之一，由承租方负责处理并承担一切费用。

将租赁机械复原或修理至完全能正常使用的状态。

更换与租赁机械同等型号，性能的部件或配件使其能正常使用。

当租赁机械毁损功灭失至无法修理的程度时，承租方应按合同附件一之规定的损失赔偿金额，赔偿出租方。

第九条双方义务和责任

出租方的义务和责任

1.密切配合承租方的施工生产，满足承租方施工要求。服从承租方施工人员的施工安排，但有权拒绝承租方的违章指挥。

2.负责配备设备操作，维护人员，负责设备的操作，日常维护保养和故障的处理，确保机械技术状态完好。如因故障造成单次连续停机超过三天以上，则超过的天数不收台班费。

3.负责操作人员的工资及设备维修配件

4.与承租方共同办理机械设备的租费签认工作。

承租方的义务和责任

1.负责工作期间租赁机械和操作司机的安全，严禁违章指挥，如违章指挥造成机械化和人员的损伤，承租方承担一切责任损失。

2.提供出租方操作司机的食宿。承担司机加班费及施工补助负责租赁期间设备保护及看守，确保发电机安全。

3.负责租赁设备的进场签认及每月租费的签认工作，负责租费的及时支付。

4.提供合格的燃油及润滑油。因燃油不合格，司机有权不加油，造成的停机损失由承租方承担。

5.租赁期间，如出租方购买零配件及材料，承租方应提供交通方便，所需资金在承租方挂支，在租费中抵扣。

6.负责租赁机械进出场运费，负责运输安全，承担运输费用及保险费。

第十条违约责任

1.承租方延迟支付设备进场费或者延迟预付机械租费时，出租方设备将延迟进场功停机。

2.未经对方书面同意，任何一方不得中途变更或解除合同，任何一方违反本合同约定，都应向对方偿付本合同总租金20%的违约金。

3.承租方如不按期支付租费或违反本合同的任何条款时，出租方有权采取下列措施：

要求承租方及时付清租费和其他费用，并要求承租方赔偿出租方的损失。

终止本合同，收回租赁设备，并要求承租方赔偿出租方的一切损失。

第十一条合同变更

1.在租赁期间，出租方如将租赁物资所有权转移给第三人，应正式通知承租方，租赁物资新的所有权人即成为本合同的当然出租人。

2.在租赁期间，承租方未经出租方同意，不得将租赁物资转让、转租给第三人使用，也不得变卖或作抵押品。

第一十二条合同效力

本合同自双方或双方法定代表人或其授权代表人签字并加盖公章之日起生效，有效期自________年________月________日至________年________月________日。本合同正本一式两份，双方各执一份，具有同等法律效力。
