包头市中级人民法院民一庭庭长   王文林

主任、各位副主任、秘书长、各位委员：

民一庭是中院的主要业务庭室，负责依法审理第一、二审有关婚姻、家庭、房地产案件及不动产相邻关系案件，第一、二审农村承包合同案件，自然人之间、自然人与法人以及其它组织之间的合同案件。此次能够接受人大常委会的工作评议，民一庭的全体同志感到无比高兴。评议我们的工作情况，这既是监督，更是一种信任。从九月十四日至九月二十五日，我们对本庭二00二年至今年九月份间审结的全部发回重审案件、全部改判案件以及随机抽取的50件维持结案、50件调解结案的案件进行了认真自查。自查工作紧紧围绕人大常委会的评议方案展开，得到了人大评议组的大力支持和有力指导。现将有关情况报告如下：

一、二00二年以来工作的基本情况

（一）牢固树立“公正司法，一心为民”的指导思想，充分发挥审判职能作用

“公正司法，一心为民”，是人民法院在“三个代表”重要思想指导下提出的一个新的理论命题。践行“公正司法，一心为民”，重点在“公正”，核心在“为民”。为此，我们制定了《司法为民的具体措施》、《保证当事人充分行使民事诉讼权利的具体措施》等一系列规章制度，向人民群众做出了庄严承诺。遵循“公正司法，一心为民”的要求，我庭切实开展自身的审判工作，忠实履行自己的法律职责，从二00二年至今年九月，共受理各类案件2614件，审结2516件，结案率达96.3%.。从总的平均情况来看，一审案件准确率达到94%，二审案件准确率达到98.7%；一审案件公开开庭审理率达到100%；二审案件公开开庭率达到92%，当庭宣判率也达到25%；一审案件不超审限率达到99%，二审案件不超审限率达到99.5%。二00二年，在我院开展的争创“双满意”活动中，民一庭荣获“满意庭室”称号；二00三年被评为“先进集体”；审判工作多次受到自治区高院的肯定和表扬。据不完全统计，仅今年一至九月，我庭就收到人民群众赠送匾额、锦旗23幅，书面感谢信或口头表扬78件（次）。

（二）尊重私权，着力搞好新形势下的调解工作

民事审判的核心在于尊重私权处分，目的在于定纷止争。探求民事诉讼的根本目的，承接人民审判的优良传统，遵循新形势下“公正司法，一心为民”的基本要求，依法做好案件的调解工作，乃是新时代厉行法治、正确处理人民内部矛盾，实现法律效果和社会效果有机统一的重要途径和有效方法。仅以二00四年为例，我庭调解、撤诉结案115件，调解、撤诉结案率接近20%，一批有影响、有矛盾激化苗头的案件得到及时有效的妥当处理，化仇情为友善，消怨艾于无形。民一庭指导人民调解工作在二00四年先后被包头市人民政府和自治区人民政府授予“先进集体”的荣誉。

（三）拓展思路，创新工作

创新是民一庭的灵魂，是民一庭立足审判实践开创过去、拓展未来的核心竞争力。这些创新集中表现在：

——制度的创新：我们着手制订和完善了《第一审民事案件审理程序》、《第二审民事案件审理程序》、《审判长联席会议制度》、《贯彻落实〈最高人民法院关于民事诉讼证据的若干规定〉的操作规程》、《民事案件法律文书签发制度》等一系列规范化制度的建设。

——思路的创新：在裁判文书的质量上变一般性的强调代之以注重日常的个案指正和规范化，在审判难点、热点上变个案的请示代之以集中调研、专题解决。组织精干力量定期编撰《包头民商事审判指导案例选编》，起草了《包头市两级人民法院关于解决民事审判中若干问题的意见》稿，并经审判委员会讨论通过。由我庭率先发起并引领的庭审观摩活动，受到了市人大常委会赵道尔基主任的充分肯定，并做出重要批示：“庭审观摩活动值得推广，司法公正只有在具体的审判实践中才得以实现，法院庭审活动的规范公正，对司法公正有着决定性意义。”

——管理的创新：我们进一步完善了电子化管理的运行平台，彻底实现了案件管理的全程电子化，并且注重扩展管理平台的附加值效应，充分利用网络资源，及时收取最新审判信息和资料，建立自己的数据库资源，为强化案件质量服务，为提高审判效率服务。

民一庭只有十五名工作人员，审判人员十二名，却承担着全院近三分之一案件的审理工作。几年来，在院党组的正确领导下，民一庭全体同志紧紧围绕“公正与效率”这一主题，以深化改革为动力，以提高素质为保证，以人民满意为标准，充分发挥乐于奉献、敢于拚搏、勤于实践、勇于创新的精神，为保护公民、法人和其他组织的合法权益，为维护社会安定、保障人民群众安居乐业做出了积极的贡献。然而，人员少、任务重的客观原因，更为主要的是主观上的懈怠、畏难情绪以及个体能力上的局限性，导致我们在工作中依然存在着诸多问题。

二、存在的问题和原因分析

（一）存在的问题

1、案件质量问题

案件质量是个大问题，有程序的，有实体的，有时涉及事实认定，有时涉及法律适用，而广义的案件质量还应当包括裁判文书质量。就目前而言，上述问题都不同程度地存在于我庭的工作中。虽然我庭当前案件的准确率在自治区名列前茅，但是，民事无小事，事事总关情，司法与民生息息相关，如何进一步提高二审案件准确率，仍然是我们面临的重要问题。此外，个别案件合议笔录签字不全，一些案件送达回证的案由、案号、受送达人、填写人等不填写或填写不全，案件呈批表填写不全面，开庭传票上写的案由与判决书中的案由不一致，有的案件证据来源未注明且是否与原件核对也未加说明，有的案件裁判文书的说理不很充分，也有漏字、错字现象。诸如此类，都需要我们在今后的工作中进一步改进，需要我们紧紧抓住案件质量这一工作的突破口，将每一件案件尽可能地办成“铁案”。

2、当庭宣判率不高

总结这一现象的根本原因，不外乎主观上、客观上和技术处理上三种。一是总的社会法治环境不尽如人意，个别审判人员基于种种社会原因主观上试图搞暗箱操作的心理依然存在；二是说明庭审质量尚待提高，个别审判人员素质有限，不能在事实认定、法律适用及即时口头表达上适应审判需要；三是民事案件的私法性质决定了有些案件宜于“冷处理”，在技术层面上需要必要的时间和空间来缓解矛盾，以收到良好的社会效果。

3、法律文书的撰写能力需着力提高

实行审判长负责制之后，一批政治、业务和文字水平都相对较好的同志走上了审判长岗位。相应地，法律文书的质量已经有了明显的提高。但是，部分文书的制作质量依然差强人意，表现在：首先，事实部分缺少对证据分析采纳情况的清楚表述；其次，对当事人诉讼请求的理由归纳不周全、不明了；第三，理由部分讲理不充分，理由阐述信服度不强。因此，加强学习的任务依然紧迫。

4、进一步加强业务指导的问题

以全面制定和落实定期审判业务交流制为突破口，加强对基层法院的指导，实现全市民事审判工作的新的飞跃，原本是今年我庭一项重要工作。所谓“定期审判业务交流制”，是指由我庭负责定期召集各基层院相关业务庭室就一段时期的审判工作难点、疑点、复杂点进行研究、讨论、交流观点，从而实现公正与效率的统一，逐步降低二审改判率、发回重审率。但由于客观的经费问题、主观的畏难情绪，使得这项工作迄今落实得不理想。

5、队伍建设的问题

毋庸讳言，虽然我们努力避免公众对民事审判公正性产生不必要的合理怀疑，大力提高审判活动的公信度。但是，从极个别案件的反映看，一定程度的问题还是存在的，个别干警“冷、横、硬”的衙门作风尚未改尽，少数人业外活动不够严谨，有的甚至为当事人说情或打探案情，有的干警在纪律上对自己要求不严，有迟到、早退现象，个别干警工作作风不够扎实，办案拖沓，效率不高。

（二）原因分析

不能否认，我们目前的法治环境尚不完善，来自权力的、人情的、甚至是金钱的干扰不同程度的存在着，地方和部门保护主义时而影响审判工作，泛法律主义、法律教条主义和法律虚无主义的思想在我们这个泱泱大国均有或多或少的要求和表现。民事法律关系纷繁复杂，不仅具有多样性，而且因为市场条件下的经济行为的创新性而导致法律关系的新颖性，从而造成行为的灵活性与制度的稳定性要求相矛盾，表现为法律制度建设的滞后性，最终影响了审判工作的展开。但是，可以肯定地说，这些因素虽属客观却不能成为当前民事审判工作存在问题的根本原因。事实上，极少数审判人员工作责任心不强，主管懈怠畏难情绪作祟，运用法学理论创造性的开展工作的能力不够，极其个别的审判人员不能有效抵制外在环境的影响而故意肆为，才是我们当前民事审判工作尚不能完完全全令人民满意，民事审判工作的公信力有所弱化的根本症结所在。

三、整改措施

（一）进一步加强人大意识，建立强有力的外部监督环境

人民代表大会是国家的权力机关，代表人民行使权力。人民法院由其产生，受其监督。进一步增强我们工作的人大意识，更加主动、自觉地接受人大的监督，是我们下一步工作的重要任务。我们已经初步制定了《民一庭接受人民代表监督暨接待群众来信来访工作的意见》，凡是人民群众和当事人本人就民一庭的工作提出质疑或意见，一定要热情接待，耐心解释，做好记录，保证件件有回音；凡是人民代表本人代表人民群众提出的问题，必须以书面形式给予答复；建立向人大常委会各位委员每半年通报一次工作的制度，将半年工作情况函寄各位委员，求得对我庭工作的进一步指导。

（二）加强队伍建设，加强廉政教育，确保司法廉洁

我庭将进一步走好“典型引路，警钟长鸣，制度规范”的队伍建设和廉政教育之路，确保司法廉洁。我们要继续深入开展向宋鱼水等优秀法官学习的活动，学习他们无私奉献的精神，确立“法不可偏、钱不可贪、官不可讨”的人生准则和“辩法析理，胜败皆服”的价值追求；我们要结合近年来民事审判队伍中发生的典型违法违纪案例，开展警示教育，针对典型案例中所暴露出来的滥用审判权力，办金钱案、人情案、关系案以及泄露审判秘密等问题，查找自身存在的问题，防微杜渐，警钟常鸣；我们将改革目前合议庭成员固定不变的做法，制定和完善相应的制约机制；我们要建立廉政谈话制度以发现苗头，庭领导要有针对性地做好工作，把问题解决在萌芽状态。

（三）建立健全审判管理制度，提高案件质量，实现司法公正

1、落实公开审判制度，做到严格规范开庭审理活动。

我们将以公开促公正，争取努力做到全部案件都开庭审理。开庭前，合议庭成员一定要审阅有关案件材料，做好庭审前的准备工作，做到心中有数，以便提高开庭审理案件的效率；在庭审中，要确保当事人充分行使诉讼权利，让当事人充分发表质辩意见，审怕人员不得随意打断当事人正常的陈诉和辩论，做到礼貌地倾听，诚心地关注；庭后要及时宣判，改变案件合议完就“松口气”、制作判决书不着急的习惯，做到案件合议后五日内完成裁判文书的制作，杜绝工作拖拉现象的发生。

在审判活动中，审判人员要严格执行最高法院关于统一着装的规定，整洁、得体地穿着法袍和制服，严禁不按规定着装现象的发生。遵守开庭时间，在庭审中遵守司法礼仪，保持良好的仪表和文明举止，对双方当事人的人格尊严给予同等的尊重，避免当事人对法官产生合理怀疑。审判人员使用语言应当严肃、准确、规范、文明，禁用司法忌语，不得对当事人或其他代理人有任何不公的训诫和不恰当的言辞，坚决杜绝以权压人、以势压人。

2、提高认证能力，真正提高审判效率。

审判人员应当充分发挥证据交换的作用，尤其是在审理一审案件时，组织当事人在证据交换阶段完成对全部证据的质证，有利于开庭时对证据的认证。诉讼中，审判人员应当对当事人充分阐明证据规则的有关规定，做好对当事人的诉讼指导工作，尽量避免当事人在开庭时利用所谓“新证据”相互突袭，导致诉讼迟延。提高当庭宣判率，能当庭宣判的尽量当庭宣判。

3、坚决杜绝超审限现象的发生。

我庭将由庭长和内勤对每一件案件建立审限台帐，根据收案时间进行督促，并根据案件的难易程度，确定不同的内部审结时间要求。目前我们实行的是：通常二审案件应在二个月内审结，一审案件应在四个月内审结，不能审结的应及时向庭长汇报。

4、提高裁判文书的制作水平，重点解决裁判文书不规范的问题。

解决这一问题，首先要提高审判人员对裁判文书质量的重要性的认识，要充分认识到规范的裁判文书不仅是法官个人审判水平的体现，更是树立司法权威，实现司法公正的重要体现。要严格按照人民法院改革纲要所提出的裁判文书改革要求，准确把握当事人争议焦点，强化对争议事实认定的说理，强化裁判理由的论证，避免一些基本的技术性错误；要严格按照最高人民法院统一规范的格式制作裁判文书，准确全面地反映出庭审概况，避免方言、土语、口语的使用，规范引用实体法和程序法，让胜诉的一方当事人清清楚楚，败诉的一方当事人明明白白；要建立健全裁判文书的审核制度，相关人员要严格把关，发现问题及时纠正。

5、继续加强调解工作，解决忽视调解、一判了之的问题。

我们将进一步重视调解在民事诉讼中的作用，既要防止忽视调解、一判了之，也要防止片面追求调解率、强迫调解。按照“能调则调、当判则判、判调结合、案结事了”的要求，贯彻自愿、公平的调解原则，使当事人通过公平便捷的程序，获得公正的处理结果，切实做到案结事了。我们还将根据案件的实际情况，实行民事调解程序前置，即对适用普通程序的案件可以在开庭前进行调解，使调解贯彻在整个民事诉讼过程中，最大限度地发挥调解的作用。此外，当前我市存在这一支庞大的人民调解员队伍，并且都进行过一定程度的法律训练，随着我院局域网的建成使用，可以将这些人民调解员的个人资料建成一个有效的资源库，与我市两级法院的广大民事审判人员共同组成一个大调解网络，共同促进社会的稳定，服务于平安包头、诚信包头、法治包头的建设。这些人员熟悉社区，可以协助送达一些不易送达的文书；了解民情，可以协助调解一些不易调解的纠纷。

6、正确对待改判和发回重审的问题。

我们要建立一套行之有效的案件评查制度和改判、发回重审案件的分析机制，不断提高裁判水平。对案情复杂或涉及新情况、新问题，原审法院确实难以审理的案件，二审法院应承担起依法查清事实、分清责任、及时作出裁判的责任，尽量不发回重审，防止“踢皮球”现象的发生。

（四）加强审判纪律，改进审判作风，提倡司法文明

我们将不断加大对审判人员进行法官职业道德的教育，确保审判人员能够严守审判秘密，不泄露合议庭等审判组织讨论案件的具体内容以及上级领导和法院对案件的意见，严格约束业外活动；要对当事人或代理人的来访热情接待，文明用语，礼貌待人，让每位来访者能感受到法官的周到热情、耐心细致和人民法院的政治本色；对当事人催办案件，法院一时又难以结案的，承办案件的法官和合议庭要耐心细致的解释和说明，特别是在人员少、任务重、困难大的情况下，更要倡导理性司法。对于当事人及代理人的无理要求，要依法有理有据地做好工作。

与时俱进，乃是马克思主义的理论品质，也是我们工作创新的思想源泉。经过此次人大常委会的工作评议，通过人大的有效监督，在院党组的坚强领导下，我们全庭上下将团结拚搏，继续提高“服务第一要务”的能力，为“十一五”规划的实施创造良好的法治环境；继续提高审判工作的质量和效率，为构建和谐社会做出新的贡献；继续巩固既有的审判成果，促进审判工作更上新水平。
